Three accused of breaking in to Bennignton man's home


BENNINGTON — Three people are charged with breaking into a Murphy Road man's house.

On Monday, in Vermont Superior Court Criminal Division, Joshua T. Amidon, 39, and Alexander Johnson, 55, both of of Manchester Center, and Emily Gillis, 36, of Dorset, each pleaded not guilty to a felony count of burglary of an occupied dwelling. Amidon and Johnson were placed under $10,000 bail. Amidon was unable to post and is being lodged in the Rutland jail. No bail was imposed on Gillis, but, like the others, she was placed under conditions that she reside in Bennington County and obey a curfew. None of them are allowed to contact each other, the alleged victim, or go to Murphy Road.

According to an affidavit by Bennington Police Officer Scott Legacy, on Sunday at 1:14 a.m. he responded to a home on Murphy Road where a male called saying a group of people had broken into his house and that he was now at a neighbor's.

When police arrived, they found Gillis driving a vehicle with Amidon and Johnson as passengers. All three said Gillis had been arguing with the homeowner all day and that he had threatened them. Eventually they decided to come down from Manchester because of the messages. They denied breaking in.

Gillis said they knocked on the front door, then went around back and found the rear door open.

The homeowner said they had all come down and kicked in his front door. He went outside and saw them enter and flip a table. He and Gillis used to date and she harrasses him. He claimed she had been sold bad "stuff' and was blaming it on him.

Legacy wrote that the front door was damaged and bore a shoe print as if someone had "mule kicked" it.
