BENNINGTON >> A Convent Avenue man has received a deferred sentence and probation for attempting to film a woman while she put on a bathing suit.

Mel T. Madison, 45, pleaded no contest Wednesday in Vermont Superior Court Criminal Division Bennington Unit to a misdemeanor count of voyeurism — first offense. He was placed on probation and given a one-year deferred sentence, meaning the court record will be sealed if he has no further trouble with the law during that period.

According to an affidavit by Bennington Police Detective Anthony Silvestro, on June 6 police received a complaint from a woman employed by a service agency contracted to work with a member of the Madison family. She said that on June 4 she went to Madison's home to work as normal when the family began to prepare for a trip to the pool at the Mt. Anthony Country Club. Madison told the woman she could use the bathroom in his home to change into her swimsuit.

As she was about to change, she picked up a hand towel from the floor and saw that it concealed Madison's cell phone which was on and currently recording video. She stopped the recording, set the phone on the sink, changed, and went to the pool as planned without speaking to Madison about the matter. When her shift ended, she contacted her supervisor and told them about the incident.

On June 7, police went to Madison's home and spoke with him. They also seized his phone, having obtained a search warrant. Madison ultimately acknowledged that he put the phone in the bathroom with the intent of recording the woman.
