A site visit will precede the start of the hearing and will occur at noon at the building and proposed project area, which is located at 135 Depot St. According to the formal notice announcing the hearing filed by the District 8 Environmental Commission, the applicants seeking the Act 250 permit, Dorset Development LLC of Manchester, are seeking to remove the existing 13,500 sq. foot structure to allow for the construction of a new 19,450 sq. foot building with two plaza areas and associated improvements.
The hearing is open to the public. Certain persons or organizations may also participate in the hearing. They include statutory parties, such as the town's planning commission, the regional planning commission and any affected state agencies. They are accorded "party status" for the hearing. Adjoining property owners and others may participate as parties to the extent that they may have an interest that may be affected by the proposed project under the 10 criteria specified under Act 250, the state's statute which regulates land use.
The district commission may allow others to participate in the hearing without being accorded party status, according to the announcement. Copies of the application and plans for the project are available for public inspection during regular working hours at the Manchester Town Offices, the Bennington Office, and the District No. 8 Environmental Office in Rutland. It can also be reviewed online by visiting the state's Natural Resources Board's Web site at www.nrb.state.vt.us/lup. Click on "Act 250 database" and enter the project number, which is 8B0617.
